Distance Sales Agreement

The rights and obligations of the parties

1. Parties and Subject

This agreement is concluded between the SELLER identified below and the BUYER placing the order, under Law No. 6502 on Consumer Protection and the Distance Contracts Regulation. Its subject is the sale and delivery of the goods ordered by the BUYER electronically.

3. Buyer and Order Details

The BUYER’s name, delivery and billing address, the characteristics of the goods ordered, their unit and total price including taxes, and any delivery charge are determined per order and sent to the BUYER with the order confirmation. Those details form an integral part of this agreement.

4. Payment

Payment is made by the method the BUYER selects at the payment step. Card payments are completed on the payment provider’s secure page; card details are not stored by the SELLER. Where payment is not completed, the SELLER is not obliged to perform its obligations under this agreement.

5. Delivery

The goods are delivered to the address given by the BUYER at checkout, within the period stated on the order and in any event within the statutory maximum of 30 days. Where delivery becomes impossible, the SELLER informs the BUYER and refunds every payment collected within 14 days.

6. Right of Withdrawal

The BUYER may withdraw from the contract within 14 days of receiving the goods, without giving any reason and without penalty. Every payment collected, delivery charge included, is refunded within 14 days of the SELLER receiving the notice. The BUYER returns the goods to the SELLER within 10 days of delivery.

7. Where the Right of Withdrawal Does Not Apply

Under art. 15 of the Distance Contracts Regulation, goods produced to the consumer’s specification, goods liable to deteriorate quickly, goods unsuitable for return on hygiene or health grounds once unsealed, and services performed instantaneously in electronic form fall outside the right of withdrawal.

8. Dispute Resolution

Disputes arising from this agreement fall within the jurisdiction of the Consumer Arbitration Committees and Consumer Courts at the BUYER’s place of purchase or residence, within the monetary limits published each year by the Ministry of Trade.

9. Entry into Force

By confirming the order, the BUYER declares that they have read the Preliminary Information Form and this agreement, understood them and accepted them. The agreement enters into force when the order is confirmed.
